1. Acceptance of Terms
By accessing or using the DaitchLens platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
These terms apply to the organization subscribing to the Service (the "Customer") and to every administrator, operator, and monitored user who accesses it under that subscription.
2. Description of Service
DaitchLens is a consent-first employee-monitoring platform. Depending on the plan and the Customer's own configuration, it provides live screen viewing, session recording, screenshots, two-way audio and chat, remote control, a consented voice call, and the consent, policy, and audit controls that govern them. The Service may be used in DaitchLens-hosted or Customer-self-hosted form.
3. Lawful, Disclosed Use — Customer Responsibilities
The Customer is solely responsible for deploying and using the Service lawfully. This includes disclosing monitoring to affected employees, obtaining any consent required by applicable law, honoring withdrawals of consent, and complying with all employment, privacy, and works-council obligations in every jurisdiction where monitored users work.
DaitchLens is designed for transparent monitoring and deliberately excludes stealth capture and hidden webcam, microphone, clipboard, and file-transfer features. The Customer agrees not to attempt to use the Service to monitor individuals covertly or otherwise unlawfully.
4. Accounts, Roles & Access
The Customer controls who is granted owner, operator, and monitored-user roles, and is responsible for the actions taken under those accounts and for keeping credentials secure. Invasive capabilities are gated by the Service, but the decision to enable them within the bounds of the law rests with the Customer.
5. Subscription & Billing
Paid plans are billed per seat, in advance, on the monthly or yearly cycle selected. Fees are non-refundable except as required by law or as expressly stated. You may cancel at any time, effective at the end of the current billing period. Free trials convert to a paid plan only if you choose to subscribe.
6. Acceptable Use
You agree not to reverse engineer, resell, or misuse the Service, interfere with its operation or security, or use it to harass, unlawfully surveil, or harm any person. We may suspend access for conduct that materially breaches these terms or applicable law.
7. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how information is collected, used, and safeguarded, including monitoring data captured through the Service.
8. Warranties & Limitation of Liability
The Service is provided on an "as is" basis without warranties of any kind. To the maximum extent permitted by law, DaitchLens is not liable for any indirect, incidental, special, or consequential damages, including claims arising from the Customer's own monitoring decisions or failure to obtain required consents.
9. Changes to Terms
We may update these terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
